These Terms and Conditions (“Terms”) apply to all products and services offered by Epiphany Training Ltd (trading as Business IT Training) (“we,” “us,” or “our”) through this website. By purchasing, registering for, or using any of our services, you (“you” or “your”) agree to these Terms. If you do not agree, do not use our services.

1. Overview

These Terms govern your use of our website, services, and products, including but not limited to:

  • Free and paid webinars (live and recorded).
  • E-learning courses (self-paced online courses and digital materials).
  • Digital content (downloadable templates, guides, or recordings).
  • Consulting and training services (one-to-one or group sessions).
  • Custom website design and development (bespoke projects).

By registering or purchasing, you confirm your acceptance of these Terms and our Refund and Returns Policy (where applicable).

2. General Terms for All Services

2.1. Payment and Pricing

  • All prices are stated in GBP (Ā£) and are subject to VAT where applicable (UK customers only).
  • Payment must be made in full before access to services is granted.
  • We accept payments via credit/debit card, PayPal, or other approved methods. Payment processing is handled securely by our third-party providers.

2.2. Access to Services

  • Access to digital products (e.g., e-learning courses, webinar recordings) is granted via email or our learning platform after payment is confirmed.
  • You are responsible for keeping your login details secure. Do not share your access credentials.

2.3. Use of Content

  • Our services and materials are provided for personal or internal business use only.
  • You may not:
    • Copy, reproduce, distribute, sell, or commercially exploit any of our content without our prior written permission.
    • Use our content to create competing courses, workshops, or training programs (whether free or paid) that replicate or closely mimic our methods, structure, or materials.
    • Teach, train, or coach others using our proprietary content, templates, or methodologies without our express written consent.
    • Upload our content to public platforms (e.g., YouTube, social media) without our permission.

2.4. Intellectual Property (Updated)

  • All content, materials, and resources provided by us (including but not limited to course structures, methodologies, templates, videos, text, and graphics) are owned by Epiphany Training Ltd and are protected by UK and international copyright laws.
  • Our unique approaches, systems, and teaching methods are considered proprietary and may not be replicated for commercial purposes.

    2.5. Limitation of Liability

    • Our services are provided for educational and informational purposes only. We do not guarantee specific results or outcomes.
    • We are not liable for any:
      • Loss of business, revenue, or profit.
      • Indirect, incidental, or consequential loss.
      • Data loss or corruption.
    • Nothing in these Terms limits our liability for:
      • Death or personal injury caused by our negligence.
      • Fraud or fraudulent misrepresentation.
      • Any other liability that cannot be excluded or limited under UK law.

    2.6. Governing Law and Jurisdiction

    • These Terms shall be governed by and construed in accordance with the laws of England and Wales.
    • Any disputes shall be subject to the exclusive jurisdiction of the English courts.
    • For customers outside the UK, these Terms apply to the extent permitted by your local law. Your local consumer rights remain unaffected.

    3. Specific Terms for Webinars

    3.1. Nature of the Service

    • Webinars are live, time-specific training sessions delivered online via Zoom or another platform.
    • After the live event, participants will receive access to a recording for a minimum of 1 weekĀ via our learning platform.

    3.2. Payment and Access

    • Webinars must be paid for in full prior to the live session.
    • Access to the live webinar and recording is conditional upon receipt of payment.

    3.3. Cancellation and Refund Policy

    • Webinar purchases are for digital content made available immediately after the live session.
    • By purchasing, you expressly agree to waive your 14-day cancellation right under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
    • Refunds will not be issued if you do not attend the live session. Access to the recording is considered full delivery of the service.
    • Refund requests made prior to the live session may be considered at our discretion, but we are under no obligation to grant a refund.

    3.4. YouTube Publication

    • We may make webinar recordings publicly available on platforms like YouTube at a later date.
    • Your purchase entitles you to early and time-limited access. No refund or compensation will be issued if the content is later made freely available.

    4. Specific Terms for E-Learning Courses

    4.1. Nature of the Service

    • E-learning courses are self-paced online courses delivered via our learning platform.
    • Access is granted immediately after purchase (unless otherwise stated).

    4.2. Cancellation and Refund Policy

    • E-learning courses are digital products considered delivered once access is granted.
    • By purchasing, you expressly agree to waive your 14-day cancellation right under UK Consumer Contracts Regulations 2013.
    • Refund requests must be submitted to contact@businessittraining.com within 14 days of purchase and will be considered at our sole discretion.
    • Refunds may be approved only if:
      • You demonstrate that the course did not deliver what was promised in the sales materials.
      • You have not completed more than 20% of the course content.
    • No refunds will be issued for:
      • Change of mind.
      • Lack of engagement with the course materials.
      • Failure to implement the guidance provided.

    5. Specific Terms for Consulting and Training Services

    5.1. Booking and Payment

    • Consulting and training sessions must be paid for in advance unless otherwise agreed in writing.
    • Appointments are confirmed only upon receipt of payment.

    5.2. Cancellation and Rescheduling

    • Appointments cancelled with less than 24 hours’ notice are non-refundable.
    • Missed sessions (no-shows) will not be refunded or rescheduled unless agreed in advance and in writing.
    • We may, at our discretion, offer to reschedule sessions depending on availability.

    6. Specific Terms for Custom Website Design and Development

    6.1. Nature of the Service

    • Custom website design and development services are bespoke projects tailored to your requirements.
    • Projects may be milestone-based or delivered in stages.

    6.2. Payment Terms

    • Payment schedules will be agreed in writing before work commences.
    • For staged projects, payments for completed stages are non-refundable.

    6.3. Cancellation and Refunds

    • Due to the bespoke nature of our development services, refunds are not available once work has commenced.
    • If you cancel a project before work begins, a full or partial refund may be issued, depending on any preparatory work already completed.
    • No refunds will be granted for:
      • Changes of mind.
      • Subjective dissatisfaction where services were delivered to the agreed specification.
      • Delays caused by your failure to supply necessary content or feedback.

    7. General Provisions

    7.1. Amendments to Terms

    • We reserve the right to update or modify these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the new Terms.

    7.2. Severability

    • If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.

    7.3. Entire Agreement

    • These Terms, along with our Refund and Returns Policy, constitute the entire agreement between you and us regarding the use of our services.
